The International Seminar on “The Past, Present, and Future of Defaults of Performance Law” was held by the Civil Law Institute of Civil and Commercial Economic Law School, China University of Political Science and Law in Conference Room B209, Xueyuan Road Campus on September 28th, 2019. The conference lasted for one day and invited professors from the University of Bonn, Germany, University of Münster, Tsinghua University, Zhongnan University of Economic and Law, Beijing University of Aeronautics and Astronautics, and Law School of China University of Chemical Technology. It was funded by the Beijing Office of the Konrad Adenauer Foundation.
The meeting was chaired by Professor Yi Jun, and was divided into two halves: the theme report on Defaults of Performance and the round-table discussion on Defaults of Performance.
In the first half “Theme Report on Defaults of Performance” part, Professor Martin Schermaier of the University of Bonn, Professor Li Yongjun of the Civil and Commercial Economic School, China University of Political Science and Law and Professor Sebastian Lohsse of the University of Münster delivered keynote speeches on “Price Reduction and Post-performance”, “Constructure of China’s Civil Law Debt System”, and “Baseline of Accountability in German Defaults of Performance Law” respectively. Professor Geng Lin, Professor Wang Hongliang, Professor Fan Lijun, Associate Professor Xia Haojin and Professor Zhou Youjun commented on the contents of the keynote speech respectively. Professor Yu Fei summarized the three reports in the first half.
During the second half “the Round-table Discussion on Defaults of Performance” session, under the auspices of Professor Li Yongjun, the experts at the meeting conducted in-depth and detailed discussions on the “Functions of the general provisions of the contract in the civil code era” and “system positioning of Defaults of Performance Law”. Professor Sebastian Lohsse, Professor Wang Hongliang, Associate Professor Shen Haien, Dr. Xie Yuanyang, Professor Martin Schermaier, Professor Zhou Youjun, Professor Yi Jun, and Dr. Miao Yu respectively addressed their views and suggestions.
The meeting was an in-depth discussion on the core issues of contract compilation from a comparative perspective of China and Germany, during the civil code legislation process, and provided in-depth and detailed amendments for the further amendment and improvement of the civil code draft directive. It also attracted nearly 40 graduate students as auditors.
